About this deal

My Executors may engage contractors or agents to assist in accessing, handling, copying, distributing, disposing of and/or terminating my digital assets. Someone close to you may have died and you think they made a will but you can't find one in their home. To find a district probate registry, search on GOV.UK at https://courttribunalfinder.service.gov.uk/search/postcode. Change of circumstances

if your circumstances have changed, it is important that you make a will to ensure that your money and possessions are distributed according to your wishes. For example, if you have separated and your ex-partner now lives with someone else, you may want to change your will. If you are married or enter into a registered civil partnership, this will make any previous will you have made invalid It's important for you to make a will whether or not you think you have many belongings, property or much money. Strictly, you do not legally own your own dead body and, therefore, cannot specify what should happen to it. However, if you make your funeral wishes clear in your Will, it is most likely that your executors and relatives will carry them out. For more information about what happens if someone dies without making a will, see Who can inherit if there is no will – the rules of intestacy. Whether you should use a solicitor Will-writing services are available. However, will-writing firms are not regulated by the Law Society so there are few safeguards if things go wrong.

How it Works

Who writes the will? Participating solicitors across the UK and in parts of Scotland and Northern Ireland. Under Scots law, if you have a child after making your Will but the Will does not include instructions for this possibility, the Will may be invalidated.

The person who has died, or their solicitor, may have registered their will with a commercial organisation such as Certainty ( www.certainty.co.uk) and, after the person's death, you can pay for a search of the wills registered on the company's database. Once you have passed away, a person will be needed to be responsible for administering your estate and ensuring the terms of the will are implemented – this person is known as an executor. There can be more than one executor acting. If you die without having made a will, then there are rules which determine who inherits your assets (your estate). They are the “intestacy rules”. For details on them see: https://www.gov.uk/inherits-someone-dies-without-will. Extra care needs to be taken when you are making a Will and including instructions about property (eg a house or a flat). In some cases, there may be a clause in the title deeds of a property called a ' survivorship destination' clause. These clauses can override what it says about the property in a Will. A solicitor can give advice about the impact of these clauses. If a grant has been made, they will send you a copy of the grant and a copy of the will, if any. A fee is payable.

3. Executors and trustees

Many couples assume that they can leave their whole estate to each other on the first death and then to the children on the second death, but legal rights mean that your children can claim a share of your moveable estate on the first death. If this is something that concerns you, you should seek specialist legal advice. 3. Executors and trustees Will-writing services are available in books and online. However, these are not regulated by the Law Society of Scotland so there are few safeguards if things go wrong. When to use a solicitor If you're not sure whether to make a will, you should consult a solicitor or a Citizens Advice Bureau which can give you lists of solicitors - where to get advice. If your circumstances change Once a will has been made the original document should be kept in a safe place. Other documents should not be attached to it because this can make it more difficult to find. There are a number of places where you can keep a will:
